Clarity and Confidence for Your Future with Rowe & Walton PC
Entering into a marriage is one of life’s most significant and joyous milestones. It is a partnership built on love, trust, and shared dreams. A key part of building a strong foundation for that partnership is open communication about your financial future. A prenuptial agreement is a practical tool that facilitates this conversation, allowing you and your partner to enter your marriage with clarity, mutual understanding, and peace of mind.
At Rowe & Walton PC, we view prenuptial agreements not as a prediction of failure, but as an act of responsible planning for a prosperous future together. From our office in Bountiful, we serve couples throughout Utah, providing discreet, respectful, and expert legal counsel to help you protect your assets and build a secure marital foundation.
A prenuptial agreement, or “prenup,” is a legally binding contract created by two people before they marry. This document outlines how their respective assets, debts, and property will be managed during the marriage and how they would be divided in the event of a divorce or death.

The Rowe & Walton PC Approach: Collaborative & Respectful
The process of creating a prenuptial agreement should be a collaborative and respectful experience. Our role is to provide sound legal advice and ensure your interests are protected while fostering a positive and non-adversarial environment.
Our process includes:
1. Doesn’t a prenuptial agreement suggest a lack of trust? Not at all. We see it as the opposite: it’s a sign of a mature, trusting relationship where both partners are willing to have honest conversations about important life topics. A prenup allows you to make decisions about your financial future together, during a time of calm and cooperation, rather than leaving it to a court during a time of stress.
2. What can be included in a Utah prenuptial agreement? A prenup can address a wide range of financial matters, including the definition of separate vs. marital property, the management of assets and debts during the marriage, protection of business interests, and terms regarding spousal support (alimony). However, it cannot determine matters related to child custody or child support.
3. Do we both need to have our lawyer? Yes. For a prenuptial agreement to be considered valid and enforceable in Utah, both parties must have their independent legal counsel. This ensures that both individuals have received impartial advice and that the agreement is entered into voluntarily and without coercion.
Protecting your future begins with a proactive conversation. Whether you are just starting the discussion or are ready to draft an agreement, the attorneys at Rowe & Walton PC are here to provide the expert guidance you need.
